Bankruptcy/Restructuring & Creditors’ Rights

Sullivan & Holston provides experience and depth in virtually every aspect of corporate bankruptcy matters. The attorneys' experience ranges from small corporate restructuring cases to some of the most complex insolvency-related proceedings and transactions over the last three decades. We regularly represent Chapter 11 debtors-in-possession, entities restructuring, and enterprises contemplating Chapter 11 protection. We also represent creditors in Chapter 7, 11 and 13 cases, including banks and other lenders, governmental agencies, creditors' committees, insurance companies, indenture trustees, landlords, corporations, investment funds, bondholders, acquisition candidates, potential acquirors, and others.

In Bankruptcy Court, the firm's attorneys have experience in obtaining relief for its clients through lift stay motions, objections to discharge and confirmation, and adequate protection actions. Sullivan & Holston's attorneys handle a wide variety of bankruptcy adversary proceedings, including preference, fraudulent transfer, lien stripping, discharge determination, stay violation, and other debtor/creditor disputes.

The firm also provides services for clients for whom bankruptcy protection is not the best solution. The attorneys know through their vast experience in restructuring matters that filing bankruptcy is not always necessary or beneficial for every client. By thoroughly evaluating each client's unique financial condition, we have successfully worked with banks and other creditors to restructure significant debt obligations for individual and corporate clients.

Appellate Law

The firm's attorneys have briefed, appeared, and successfully argued appeals in the United States Fifth Circuit Court of Appeals and many Texas civil appellate courts. The firm has successfully represented both appellants and appellees.

Business Transactions

The firm and its lawyers routinely assist clients with their business and transactional needs. Representation in these matters includes the analyzing, drafting, reviewing and negotiating of all types of contracts, including:
